The program
These SMS Terms cover text messages sent by Edan Labs (“Megaphone”) through the Megaphone messaging program, on behalf of Megaphone and the curators you request or book with. There are two kinds of messages: Megaphone Alerts (transactional) and Megaphone Offers (marketing).
How you opt in
You opt in on the consent screen when you sign up or send your first request. There are two separate choices.
- Megaphone Alerts. You agree: “I agree to receive texts and emails about my requests, options, payments, passes and bookings. Msg & data rates may apply. Reply STOP to cancel, HELP for help.”
- Megaphone Offers. A separate, optional toggle that is off by default. You agree: “I agree to receive recurring marketing texts from Megaphone and the curators I book with (Megaphone It broadcasts, Inner Circle drops and new nights), sent by automated means. Up to 6 texts a month. Msg & data rates may apply. Reply STOP to cancel, HELP for help. Consent is not required to book.”
Consent to marketing texts is not a condition of booking or buying anything. You can book without opting in to Megaphone Offers. We keep a record of your consent, including the version, time, device and method.
What we send
Megaphone Alerts are sent because you made a request or booking. They include one-time verification codes, new options from your curator, payment links and receipts, split invitations and reminders, passes, and booking changes. You get them as long as you have activity in your account. They continue after you opt out of marketing.
Megaphone Offers are optional marketing. They include broadcasts from your curator (Megaphone It), Inner Circle drops and early access, and new nights. We send them on behalf of Megaphone and the curators you book with.
Message frequency
- Megaphone Alerts: message frequency varies depending on your booking activity.
- Megaphone Offers: up to 6 marketing texts a month, in total across Megaphone and your curators.
Message and data rates may apply, according to your mobile plan.
Quiet hours
We send marketing texts only between 8 AM and 9 PM in your local time. We work out your local time from your phone number and the details you give us. Transactional texts, such as verification codes and payment confirmations, can arrive at any hour, because you are waiting on them.
Stop, start and help
You can cancel at any time. Reply STOP to any message. You can also use STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT. After you reply STOP, you get one confirmation message and then no more texts from Megaphone at that number, including Megaphone Alerts.
To start again, reply START. For help, reply HELP, or email support@megaphone.bio.
STOP ends every Megaphone text to your number. After that, booking updates, payment links and passes reach you by email instead. To stop only marketing texts and keep booking updates, turn off “Drops and new nights by text” in Settings.
Sample messages
Curators’ obligations
Curators agree to the Messaging Program terms of the Curator Agreement. They may only text clients who have opted in. Megaphone enforces consent, quiet hours (8 AM to 9 PM recipient time) and STOP and HELP on every message. Messages to clients who have not opted in are blocked. Curators cannot upload purchased or scraped lists.
Megaphone never contacts a curator’s clients for its own marketing. See /curator-agreement.
Carriers and delivery
The service is available on major US mobile carriers. Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier, your coverage and your device, and we cannot guarantee it. Not all carriers or phone types are supported.
Privacy
We use your number to send you the messages you signed up for and to run the Service. Read our Privacy Policy at /privacy.
We do not share, sell or rent your mobile number or SMS opt-in consent with third parties or affiliates for their marketing purposes.
Changes and number changes
We may update these SMS Terms and will update the version and date when we do. If you change phone numbers, tell us so we can stop texting your old number, which may be reassigned to someone else. Reply STOP from the old number if you can.
